Will try my best...I've got privacy fences all around me,both sides and across the street,none are mine,when I moved here in 1999,got a letter from a lawyer tellin me I had to tear the fence down that was here when I bought the lots...smh...thats basicly when I said screw this hoa,never gave them nuthin,till all pro took over and offered amnesty on 20 yrs of back dues,It was then I decided,well,can't beatem,may as well join em,b4 they take my house.It's gonna be uphill battle,kinda a sweet,sour relationship,but I'll give it my best...thanx for your vote and encouragement......

Freedom land, I think you are a little confused. EMPOA dues have never been mandatory period! The EMPOA has always asked for contributions for membership renewal but have never threatened to put liens on properties unless their property was considered unsightly with trash build up. To which the board had the right to request the property owner to clean it up. If not ,the board then had the right to assign someone to clean their mess up and seek reimbursement plus 10% of the clean up cost. If the owner then failed to reimburse the board for the job carried out the board was within their right to place a lien on the owners property. I don't know what kind of fence you had in mind of erecting, but if you had submitted your request to put up a fence to the committee for review/approval you might now have owned a nice piece of property. As Louie affirmed we have variance forms to help in these situations. I also agree that our covenants are in a lot of ways outdated, and need work on. But...

Charles, AllPro didn't have to offer amnesty to Amy property owner because dyes were never mandatory in the first place. It's a smoke screen that the board of 2018 created to push their agenda for mandatory dues. That's what the newer property owners don't realize. If these new owners have their current covenants there's no mention anywhere on that document stating voluntary or mandatory dues....

Why couldn't we vote on the individual changes you wish to add to the covenants? I agree with some of them, but not all of them. I really wish we could have voted on exactly what changes were going to be made... INDIVIDUALLY. Not an "all or nothing" situation. There are some things that don't sit right with me, therefore my vote would be NO for the changes although there are some changes I wish would happen....

Shark tooth, unfortunately that is not the way our original covenants were written. They were written so that every 10 years amendments to covenants as a whole with a proper vote may change or automatically renew. 2024 just so happens to be the year that we have to change them, or we will be automatically stuck with the same old outdated covenants until 2034. Actions and inaction have consequences, what are you willing to live with. Do you mind a 3 story shipping container home pulled up next to your cabin?
Container homes weren’t even a thing when our original covenants were written. So we badly needed to update the language to reflect a more modern time. Just to clear up some false information that has been passed along, dues are mandatory. Just because a rule is not worded in someone’s preferred language doesn’t make it unenforceable. We have no plans on filing for liens on properties, but it sure takes a lot of money that could be better spent on roads instead of lawyers.

in the covenants,on page 7 of the pdf or marked page 29 on paper,it states in #16-terms; in 2024 the majority of owners can change the covenants whole or in part......

The word “ mandatory “ was suggested by the lawyer to end this debate. Even if the covenants aren’t approved, they are still mandatory in accordance with SB 405 that was ratified in 2015. This is not the first time we have had this discussion, and I have the letters from the lawyers to prove it. I would be weary of someone that has told you what you want to hear vs people telling you the inconvenient truth....

Louie, I said that NOWHERE is it written in our covenants that dues are mandatory OR voluntary. Please don't misquote me and if you are going to accuse me of such be upfront and use my name. You can not imply mandatory nor voluntary. It has to be written. You need to make visible to these members exactly where it is written in the covenants that the word mandatory is documented....

Yes, that is what was added to make things in the future easier, it is in the proposal for the amendments. Unfortunately it is not in the current covenants. Thanks for actually reading the proposed amendments, we spent a lot of time on that prior to the lawyer reviewing them....
